Scotland’s soils provide us with many benefits and we need to protect our soils so that they can continue to provide these benefits in future.

Although there is no one-size-fits-all soil protection policy for Scotland, there is a range of legislation and policies that protects some aspects of soil and influences how our soils are managed. **From 1 November 2025, regulation of water, waste management and industrial activities move under the Environmental Authorisation (Scotland) Regulations 2018 (EASR). This consolidates (and supersedes) previous regulations that affect or are affected by soils, including the Pollution Prevention and Control (Scotland) Regulations (2012), Waste Management Licensing (Scotland) Regulations (2011), the Water Environment (Controlled Activities) (Scotland) Regulations (2011) and the Sludge (Use in Agriculture) Regulations (1989).**
